PRINCIPLES RELATING TO THE COLLECTION AND PROCESSING OF PERSONAL DATA

According to Article 24 of the Constitution of the Kingdom of Morocco, “Everyone has the right to the protection of their private life.” Article 27 further states that “the right to information may only be limited by law, in order to ensure the protection of all matters related to national defense, internal and external security of the State, as well as individuals’ private lives, and to prevent violations of the rights and freedoms set out in this Constitution.”

Law 09-08 on the protection of individuals with regard to the processing of personal data outlines the rights and obligations of all individuals and entities in terms of online data protection.

All personal data collected, processed, and stored via the institutional portal at this link  are handled in accordance with the procedures outlined in this policy and in compliance with the aforementioned laws.

What do “personal data,” “processing,” “data controller,” and “DPO” mean?

Personal data refers to any information about an identified or identifiable individual. This may include a person’s name, photo, phone number, code, password, date of birth, or email address.

Processing refers to any operation involving personal data. It includes, among other things, collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, transmission, dissemination or any other form of making data available, alignment or combination, restriction, erasure, or destruction.

The Department of Moroccan Expatriates (DMRE) is the data controller for your personal data. It is responsible for determining the purposes and means of processing and for responding to any questions regarding the use of this data.

Who is concerned?

Our policy applies to any individual or entity that identifies themselves and connects to the institutional portal.

What data is covered by this policy?

When you register and log in to this portal, we may collect personal data about you:

  • Identification data (name, surname, country and city of residence, time zone);

PURPOSES OF PERSONAL DATA PROCESSING

For each processing activity, only the data that is relevant and necessary to fulfill the intended purpose is processed. Furthermore, we commit to processing your personal data only in ways that are compatible with and proportionate to the purposes for which it was originally collected.

We collect your data for the following purposes:

General Purpose

  • To inform, guide, and support Moroccans residing abroad.

Specific Purposes

  • To manage registrations for cultural and educational activities;
  • To manage scholarship applications for Moroccan students abroad (MRE);
  • To manage contact requests;

PROTECTION OF PERSONAL DATA

We are committed to maintaining the confidentiality and security of your personal data. To this end, we have implemented technical and organizational security measures to prevent destruction, loss, falsification, alteration, unauthorized access or disclosure to third parties, and any other unauthorized processing of your data.

We have taken all necessary steps to ensure the confidentiality, integrity, and availability of the information systems that process personal data.

The portal offers various types of content, including links to third-party websites (public/private partners) whose terms of use fall outside the scope of this Policy. We therefore recommend that you carefully read their personal data protection statements.

ACCESS TO PERSONAL DATA

The services authorized to access your data are precisely determined based on their responsibilities and level of involvement.

To improve the quality of services offered, the DMRE engages specialized service providers who intervene securely at certain levels of the portal. These providers are contractually bound to the DMRE and must therefore comply with the principles outlined in our Privacy Policy.

In this regard, the DMRE ensures that these providers:

  • Only have access to the data necessary for the performance of their tasks;
  • Commit to processing this data securely and confidentially, and use it solely for the execution of their missions;

The DMRE does not share your data with third parties for commercial use under any circumstances.

DATA RETENTION

We retain your data for the duration of the legal limitation period or any other retention period required by law. If no specific retention period is prescribed by law, we determine the duration based on the purpose for which the data was collected. We do not retain your data longer than necessary to fulfill the intended purpose.

We guarantee limited access to archived data and commit to deleting or anonymizing your personal data once the retention period has expired.

Right to Information

It is our duty to inform you about the collection and processing of your personal data.

CONDITIONS FOR MODIFYING THE PRIVACY POLICY

The DMRE may modify or update this Privacy Policy to reflect changes in our practices regarding the processing of your personal data or changes in applicable laws.

We invite you to regularly consult the latest version published on the portal.

CONSENT COLLECTION METHODS

Out of respect for your privacy, we emphasize the importance of obtaining your consent before collecting any personal information about you. This consent may be explicit, such as checking the box “I have read and accept.”

However, we also recognize the validity of implicit consent, which may reasonably result from your actions or inaction. For example, providing your name and address to receive our newsletter, or giving your name and phone number to receive a response to a question while using our portal, is interpreted as implicit consent to the collection of personal data.

Any change in the aforementioned purposes will require a new request for consent, except in the case of a specific request from State authorities.

In accordance with our legal obligations, we will notify the competent supervisory authorities within the timeframes prescribed by law. If a data breach presents a high risk to your rights and freedoms, we will also inform you in a transparent and concise manner, providing the necessary information to help you take appropriate measures to protect your data.
